Abstract

This study comes as a result of practises and rituals performed by women during their husband’s death, or one of their relatives , ignorant of the provisions of mourning stipulated in Islamic law, to control the concept of mourning in the first place, and to highlight its jurisprudence under the continuous and emerging customs according to, giving the following problem: What is the concept of mourning in Islamic jurisprudence and the some given customs? To answer that equality, the study adopted the descriptive approach to presenting and explaining the principles and Jurisprudence judgements, and as I followed the comparative approach considering the study that combines jurisprudence and customs, as I also used the extrapolative method in tracking the particulate judgements passing through the texts ending with the total origin. It has been called a conceptual research, and a research that includes a direct topic, the first is in terms of controlling the concepts of mourning and its legitimacy, and the related provisions, divisions and conditions, and the second dealt with the provisions of mourning in Islamic jurisprudence and the following customs, with exposure to its purposes, and some of the findings. And to complement the above, the study concluded on the need to abide by the provisions of mourning contained in the special texts, while judging the glasses of Sharia, the correct custom on which the messages of mourning are based in the continuous and desirable customs and their return.
