Abstract: | This study dealt with the subject of provisions related to polygamy - a jurisprudential study - after knowing the term marriage and marriage, both in language and in Sharia, it touched on the legality of polygamy and its conditions, and the opinions of some contemporary scholars on it, then it dealt with the issues and rulings related to polygamy through the Holy Qur’an And the Sunnah of the Prophet, and the sayings of scholars according to the limits of the study. As I learned that the term “marriage” is one of the Qur’anic terms, so the jurists titled their books with the Book of Marriage, and that the use of the term “marriage” is a modern term that is commonly used with contemporary jurists. Moreover, the issue of polygamy has received the attention of scholars, both in recent times and in the past. There have been long discussions about its legality and the wisdom of it, even though the Holy Qur’an and the verbal and practical Sunnah of the Prophet were separated in its legislation and that it is a divine instinct. The study also dealt with the oath and its provisions, as its basis is justice between wives in terms of alimony, clothing, accommodation, and other material matters, as the Messenger of God, may God’s prayers and peace be upon him, said: “Oh God, this is my oath in what I possess, so do not blame me for what you own or your mother.” The memorandum also presented other issues related to polygamy, such as the issue of the wife's private housing, which is the cause of many cases |
