السياسة الجنائية في ظل القانون 24-02 يتعلق بمكافحة التزوير واستعمال المزور

Abstract

في ظل تفشي واستفحال جريمة التزوير واستعمال المزور وما ينجر عنها من آثار وخيمة على الوطن والمواطن، انتهج المشرع الجزائري سياسة وقائية وردعية في مواجهة هذه الجريمة حينما سن أحكام القانون رقم 42-02 المتعلقة بمكافحة التزوير واستعمال المزور كقانون مستقل بذاته يتعلق بمكافحة التزوير واستعمال المزور بصفة مستقلة عن قانون العقوبات. بهدف أخلقت الحياة العامة وتعزيز الثقة، حيث تضمن إجراءات ردعية إضافة الى قواعد موضوعية لمكافحة التزوير واستعمال المزور منها ما هو جديد كالذي يتعلق بآليات المساعدة في الكشف عن جرائم التزوير، كما وسع من دائرة التجريم للوقاية من جرائم التزوير وشدد العقوبة على بعضها بعقوبة الحبس والغرامة المالية وكريس البُعد الدولي للقانون 24-02 بامتداد تطبيقه عن الجرائم حتى إذا وقعت في الخارج.

In light of the widespread and escalating crime of forgery and the use of forged documents, and the dire consequences they entail for the nation and its citizens, the Algerian legislature adopted a preventative and deterrent policy to combat this crime by enacting the provisions of Law No. 42-02 on Combating Forgery and the Use of Forged Documents, a standalone law dealing with the fight against forgery and the use of forged documents, independent of the Penal Code. The law aims to moralize public life and enhance trust. It includes deterrent measures in addition to objective rules to combat forgery and the use of forged documents, including new ones, such as those related to mechanisms to assist in detecting forgery crimes. It also expanded the scope of criminalization to prevent forgery crimes and increased penalties for some of them, including imprisonment and a fine. Law No. 24-02 also emphasized the international dimension of its application, extending its application to crimes even if they occur abroad.
