أوامر قاضي التحقيق في التشريع الجزائري

Abstract

تُعد أوامر قاضي التحقيق أدوات إجرائية محورية في مرحلة التحقيق القضائي، حيث تتناول هذه الدراسة تحليلًا لمختلف أنواع الأوامر الصادرة عنه، مثل أوامر الإيداع في الحبس المؤقت، وأوامر القبض، مع التركيز على شروطها القانونية وآثارها الإجرائية. وتم تسليط الضوء على مدى التزام التشريع الجزائري بمبادئ الشرعية وضمانات حقوق المتهم، لا سيما من حيث وجوب التسبيب، الشكل الكتابي، وإمكانية الطعن في تلك الأوامر. وعلى الرغم من أن قاضي التحقيق يتمتع بسلطة تقديرية واسعة، إلا أن هذه السلطة تظل محاطة بضوابط قانونية صارمة تحول دون المساس بحقوق الأفراد.

This thesis examines the legal framework governing investigative judge orders in Algerian legislation, considering them essential procedural tools during the judicial investigation stage. It analyzes various types of orders, including summonses, arrest warrants, and committal orders, with attention to their legal conditions and procedural consequences. The study evaluates the extent to which Algerian law ensures compliance with the principles of legality and the rights of the accused, particularly regarding the justification, written form, and appealability of such orders. While investigative judges exercise significant discretionary power, this authority is bounded by legal safeguards to prevent violations of individual rights.
