الضبط الاداري في أحكام الممتلكات الثقافية في الجزائر

Abstract

تناولت هذه الدراسة موضوع الضبط الإداري في أحكام الممتلكات الثقافية في الجزائر من خلال معالجة ثنائية تجمع بين البعد المفاهيمي والإطار التنظيمي لحمايتها. خصص الفصل الأول لدراسة الإطار المفاهيمي للممتلكات الثقافية عبر تحليل التعاريف والمعايير المعتمدة دوليا ووطنيا مع إبراز طبيعتها القانونية وتحديد أصنافها سواء كانت عقارية منقولة أو لامادية وكذا سبل دمجها ضمن الأملاك العامة أو الخاصة. أما الفصل الثاني فعني باستعراض أنظمة الحماية الإدارية المقررة لهذه الممتلكات والقيود التي ترد على الملكية الخاصة ضمانا لحمايتها من خلال آليات التسجيل التصنيف نزع الملكية والارتفاقات الثقافية مع تحليل دور الهيئات المختصة سواء على المستوى المركزي أو المحلي في تنفيذ هذه الآليات واستعراض أدوات التخطيط العمراني كوسائل فعالة للضبط الإداري في مجال حماية الممتلكات الثقافية.

This study addresses the issue of administrative control of cultural property in Algeria through a dual approach that combines the conceptual dimension and the regulatory framework for its protection. The first chapter is devoted to examining the conceptual framework of cultural property, analyzing internationally and nationally adopted definitions and standards, highlighting its legal nature and identifying its categories (real estate, movable, or intangible), as well as ways to integrate it into public or private property. The second chapter reviews the administrative protection systems established for this property and the restrictions imposed on private property to ensure its protection through mechanisms of registration, classification, expropriation, and cultural easements. It also analyzes the role of competent bodies, both at the central and local levels, in implementing these mechanisms, and reviews urban planning tools as effective means of administrative control in the field of cultural property protection.
