أدلة الإثبات ودورها في تكوين القناعة الشخصية للقاضي الجنائي

Abstract

إن هذه الدراسة تهدف إلى مناقشة إشكالية مدى تأثر القناعة الشخصية للقاضي الجزائي بمختلف أدلة الإثبات، وهل هاته القناعة مطلقة، وعليه نخلص مما عرضناه أن المشرع الجزائري لم يشذ عن المبدأ الأساسي للإثبات الجنائي القائل بحرية الإثبات الجنائي بكل الوسائل المشروعة، ويتجلى ذلك من خلال ما جاءت به المادة 212 ق إ ج ج، إلا في الأحوال التي ينص فيها القانون على غير ذلك، وله أن يصدر حكمه تبعا لاقتناعه الخاص، ويستوي في ذلك كل من الأدلة التقليدية الأدلة العلمية الحديثة .

This study aims to address the issue of the extent to which the criminal judge's personal conviction is influenced by various types of evidence, and whether this conviction is absolute. Based on the analysis presented, we conclude that the Algerian legislator did not deviate from the fundamental principle of criminal evidence, which is the freedom to prove criminal acts by all lawful means. This is clearly reflected in Article 212 of the Algerian Code of Criminal Procedure, except in cases where the law provides otherwise. The judge may issue a ruling based on his personal conviction, whether the evidence is traditional or based on modern scientific methods.
