عمل أهل المدينة عند الإمام أبي بكربن العربي من خلال كتابه القبس

Abstract

ــ يتناول هذا البحث أصلا مهما من أصول المذهب المالكي الا وهو عمل أهل المدينة و الذي اعتمده الإمام مالك في الكثير من ابواب فقهه وبنى عليه الكثير من الفروع الفقهية , وتبعه بذلك بقية الأئمة ولو نقل عنهم عدم القول به إلا أنهم أعملوه في فروع شتى , كما تناول البحث شخصية مرموقة في المذهب المالكي تعد من أعمدته وهو الإمام الحافظ الفقيه المحدث , قاضي القضاة , عالم الأندلس وشيخ شيوخها في زمانه وهو القاضي أبو بكر محمد بن العربي المعافري الإشبيلي ا لأندلسي , كما تناولنا بالبحث في أهم مؤلفات القاضي ابن العربي كتابه " القبس " و الذي يعتبر من أمهات المذهب المالكي فقد اتخذه العلماء من بعده مرجعا يرجعون إليه في تحرير مسائل الفقه . وقد جاء هذا البحث تحت عنوان " عمل أهل المدينة عند الإمام أبوبكر ابن العربي من خلال كتابه القبس " , وكانت الإشكالية الرئيسية له هي" ماهي تطبيقات عمل أهل المدينة التي ذكرها ابن العربي في كتابه القبس" فدار البحث حول ثلاثة مباحث كان أولها ترجمة الإمام ابن العربي وكتابه القبس كمبحث تمهيدي للموضوع , ثم كان المبحث الأول حول مفهوم عمل اهل المدينة ,حجيته ,مصطلحاته واقسامه , ليختم البحث بمبحث ثان حول الشواهد التطبيقية لعمل أهل المدينة من خلال كتاب القبس. وفي ختام البحث توصلت لنتيجة مفادها أن الإمام ابن العربي ذكر تطبيقات متنوعة لعمل أهل المدينة في كتابه القبس , فرغم قلتها إلا أنها تنوعت بتنوع أبواب الفقه , فلا تجد باب إلا وله ذكر لمسألة بناها الإمام مالك ـ رحمه الله تعالى ــ على عمل أهل المدينة. - This research deals with an important origin of the origins of the Maliki doctrine, which is the work of the people of the city, which was adopted by Imam Malik in many of the doors of jurisprudence and built it a lot of branches of jurisprudence , followed by the rest of the imams, even if they were quoted not to say it, but they , We also dealt with research in the most important writings of Judge Ibn Al-Arabi book "Al-Qabas", which is considered one of the mothers of the Maliki school has taken the scholars after him as a reference to him in the liberation of issues of jurisprudence . This research came under the title "the work of the people of the city when Imam Abu Bakr Ibn Al-Arabi through his book Al-Qabas ", and the main problem for him was" what are the applications of the work of the people of the city mentioned by Ibn Al-Arabi in his book Al-Qabas" the research was conducted on three topics , the first of which was the translation of Imam Ibn Al-Arabi and his book Al-Qabas as a preliminary research on the subject ,then the first topic was about the concept of the work of the people of the city ,its Hijjah , terms and divisions, to conclude the research with a second topic on the applied evidence of the work of the people of the city through the book Al-Qabas . At the end of the research, I came to the conclusion that Imam Ibn Al-Arabi mentioned various applications for the work of the people of the city in his book Al-Qabas, although I said it, but it varied with the diversity of the doors of jurisprudence, do not find a door only has a mention of the issue built by Imam Malik-God's mercy-on the work of the people of the city.
