أوقاف ضاية بن ضحوة : حصر و تقييم في ضوء الفقه الإسلامي و القانون الجزائري

Abstract

تهدف هذه المذكرة إلى دراسة واقع الأوقاف في منطقة ضاية بن ضحوة، بولاية غرداية، من خلال حصرها وتقيميها في ضوء أحكام الفقه الإسلامي والتشريعات القانونية الجزائرية. ومنطقة ضاية بن ضحوة ذات إمكانًت جغرافية وبشرية وإدارية تصلح إطارا مشجعا لإنشاء أوقاف متنوعة ولاستثمارها. وهذه الأوقاف عقارية ومنقولة، وأبرز أوقاف ضاية بن ضحوة العقارية المساجد، وأهمها المسجد العتيق الذي أدى دوره الثوري وهو يواصل مهامه العلمية والاجتماعية. إضافة على أوقاف الطرق والآبار التي توفر تسهيلات كبيرة للسكان. كما الأوقاف المنقولة، التي تشمل وسائل تعليمية وطبية واجتماعية، لها دور فعال في خدمة مختلف شرائح المجتمع. وبتقييم أوقاف منطقة ضاية بن ضحوة تظهر بوضوح آثارها الإيجابية إيمانيا وتعليميا واقتصادية، دون أن تخلو من بعض المعوقات مثل: غياب التوثيق القانوني، إهمال بعض الأوقاف وضعف صيانتها. This research aims to study the status of endowments in the Dayet Ben Dahoua region, of Ghardaia province, by inventorying and evaluating them in Islamic jurisprudence and Algerian legal legislation. The Dayet Ben Dahoua region has geographical, human and administrative potentials that are suitable as an encouraging framework for the establishment and investment of various endowments. These endowments are real estate and movable. The most real estate endowments in Dayet Ben Dahoua are mosques, the most important of which is the old ]Atik [mosque, which has played its revolutionary role and continues its scientific and social missions. In addition, endowments for roads and wells provide significant facilities for residents. Movable endowments, which include educational, medical and social, also play an effective role in serving various segments of society. By evaluating the endowments of the Dayet Ben Dahoua region, their positive impacts on faith, education and the economy are clearly evident, although they are not without some obstacles such as: the absence of legal documentation, neglect of some endowments and poor maintenance.
