الفروق الفقهية في باب الشركات

Abstract

يعالج هذا البحث دراسة الفروق الفقهية في باب الشركات، وهذا من خلال كتب أصول الفقه في المذاهب الأربعة المشهورة، متبعة المنهج الوصفي في الجانب النّظري، والمنهج التّحليلي في الجانب التّطبيقي في تحليل المسائل ومناقشتها. فالبحث هنا تم تجزئته إلى فصلين مهمين، حيث الأول قد وظّفته في الجانب النّظري الذي هو عبارة عن التّعرف على الفروق الفقهية من حيث تعريفها وبيان أهميتها ونشأتها ومستندها، أما الثّاني فقد تناولت الفروق الفقهية المستخرجة من بعض الكتب لكل مذهب من المذاهب الأربعة المشهورة. وتوجت الّرسالة الخاتمة بأهم النتائج المستخلصة و

المتوصل إليها من خلال إنجاز هذا البحث أذكر منها: - أهمية الفروق في باب الشركات وحرصها على محافظة على حقوق الشركاء وأموالهم وتحقيق العدل والمساواة في الربح والخسارة وتحمل الأعباء من خلال توزيع المهام والأعمال، وأن الأرباح والخسائر توزع وفق لرأس المال. - نزول الاستجابة لرغبة الشركاء في كيفية إدارة شركاتهم سواء كان ذلك بتفويض أو بشكل كامل وإعطائهم الحرية في اتخاذ القرارات التي تلبي رغباتهم دون تدخل خارجي. - إن الشركات وفًقا للفقه الإسلامي لا تتمتع بأي امتيازات على حساب الأفراد ولا تُعفى أموالها من الحماية التي تشمل أموال الأفراد. This research addresses the study of Fiqh differences in the topic of partnerships, through the books of Usual al-Fiqh in the four major schools of thought. The descriptive method was followed in the theoretical aspect, while the analytical method was applied in the practical aspect, analyzing and discussing the issues. The research was divided into two important chapters. The first focuses on the theoretical side, which involves understanding the Fiqh differences in terms of their definition, significance, origins, and sources. The second chapter discusses the Fiqh differences extracted from some books of each of the four famous schools of thought. The thesis concludes with the most important findings derived from the research, encouraging students of knowledge to study and understand the Fiqh differences in terms of their significance and origins. Fiqh differences are closely linked to the principles of fiqh as well as to rational and textual evidence. The research also emphasizes the need to coordinate libraries and link them electronically to facilitate easy access to information for students of knowledge .
