الخلاصة:
The istallment sale contract has a major role in financial transactions
nowdays ,and its importance increase if it is associated with Islamic bank which
means ,it is of interest to researcheres .they held on it to their seminars and
conferneces .Also ,they dealt with research and studies .And now ,it ‘s stilling a
subject of wide discusion among a specailist and veriouse dealers.
The sale of installment is faced some problems and doubts ,as it is applied by
Islamic bank .With great role that it has,it penetrate into the field on financial
transactions and and it attempts to clarify and remove what is possible of these
problems .I spotlight on this topic which is ;selling by installement as conducted by
Al Salam Bank-a legal legal study .
I start my dissertation with the first chapter that , i tackled the diffinition of
Insallement sale in Sharia Law and i showed its relationship with others sales
dealing with provision and controls of installement sale in Sharia and Law
focusing on the issue of increase in the price for the term ,as it is an issential point
in the sale by installments,dependent on Mothers Books on the basis of that
.Iconcluded this chapter by comparing Sharia and Law
Moving the second chapter contains Al Salam Bank (diffinition),then i
loocked at the development of the Islamic Bank as a previouse study and up to the
form they are ,dealing with financing formulas that Al Salam Bank relise on ,and
showed the installent sale system as conducted by Al Salam Bank.
At the end ,the third chapter is devoted to evaluating the installemt sale
system in Salam Bank ,focusing on the problems related to the conditions in the
both « agreement and contract » as seriousness guarntee margin, commitment to
donation ,solutions to the remaining installment upon delay ,insurance ,the
condition of innoncence from defects,mortage of amounts and Payment Debt in
different currency and clearing ,the necessity to open a current account ,and
transfer the commodity to the Warehose
My conclusion was to show the most inportance finding and recommendations
which i think should be followed.
