Abstract:
The one who reads the objectives of the Sharia finds that it came to do
justice to the person, and among the requirements of fairness is the protection of
his honor and himself, and among the manifestations of that is fighting everything
that would violate his honor, such as assaulting him, so this study aims to research
the rulings on the woman who has raped and the consequences of this rape. And it
came under the title "Rulings of a woman raped in Islamic jurisprudence." Through
it I dealt with the rulings on the rape of women in the jurisprudential aspect, and
dealt with some of the jurisprudential rules that set them. And by mentioning the
reality of rape in the first section, in which she touched on the concept of rape and
mentioned its elements and conditions, then in the second section I dealt with the
limits of coercion, explaining its status and conditions. Then, in the third section, I
touched upon some of the provisions related to the child of a raped woman, so I
dealt with the ruling on his abortion and then attributing it to those who prove I
also mentioned the issue of his alimony, and in the fourth study I dealt with some
of the rulings related to the woman who has been raped, and in it I dealt with the
rulings related to the hymen and the issues that are being dragged on it, then I
touched upon the ruling on her marriage to her usurper and other than her rapist,
and after that I dealt with the issue of the dowry of the rapist, is it proven for her to
dowry or not? And concluded the research with a final study in which I dealt with
how Sharia preserved the presentation in light of the texts and the general and
jurisprudential rules, and I ended the research with a conclusion that includes the
most important results, and I attached it to the required indexes.
