التّضامن الاجتماعي والاقتصادي وأثـــــــره على الفقه الإسلامي من خلال صوره المعاصرة

Abstract

تهدف هذه الدّراسة إلى التّطرّق لمفهوم التّضامن ببعديه الاجتماعي والاقتصادي وبيان العلاقة التّكامليّة بين الجانبين، وإبرازه كنظام متكامل وشامل لكلّ جوانب التّشريع الإسلامي وذلك من خلال التّأصيل الشّرعي وذكر الأسس والمبادئ الّتي يرتكز عليها، وكذا بيان أهمّ الوسائل الّتي اعتمدها في تحقيق النّتائج المرجوّة على مستوى المجتمع، وتتبّع أهمّ هذه الوسائل والآليّات قديما وحديثا، مع ذكر أثرها وخاصّة الصّور المعاصرة منها سواء- القديمة المتجدّدة المتكيّفة مع ظروف العصر وتعقيداته أو الجديدة- على الفقه الإسلامي، وأهميّة الاجتهاد في ضوء الشّريعة الإسلاميّة في هذه الصّور جميعها، وذكر أهمّ التّحدّيات الّتي تواجه الفقه الإسلامي في هذا المجال، واقتراح الحلول الممكنة من أجل الوصول إلى إبراز أهمّيّة وجود نظريّة متكاملة حول التّضامن الاجتماعي والاقتصادي نظرا للحاجة الملحّة إليه، وتوجيه الأنظار إلى ضرورة اهتمام الدّراسات المعاصرة بهذا الموضوع والتّركيز عليه قصد تبنّيه في المجتمعات والدّول الإسلاميّة والّتي هي في أمسّ الحاجة إليه في وقتنا الرّاهن. This study aims to address the concept of solidarity in its social and economic dimensions, highlighting the complementary relationship between the two and presenting it as a comprehensive and integrated system encompassing all aspects of Islamic legislation. The research undertakes a jurisprudential foundation by identifying the principles and bases upon which solidarity is established, as well as examining the primary mechanisms employed to achieve the intended outcomes at the societal level. It traces these mechanisms and tools, both historically and in contemporary times, while emphasizing their impact—particularly the modern manifestations, whether renewed and adapted to current circumstances or newly developed—on Islamic jurisprudence. The study further underscores the importance of ijtihad in light of Islamic law across all such forms, identifies the main challenges facing Islamic jurisprudence in this domain, and proposes possible solutions to demonstrate the necessity of formulating an integrated theory of social and economic solidarity. This is especially crucial given the urgent need for such a framework and the imperative to direct contemporary research towards adopting and applying it within Muslim societies and states in the present time.
