صرف الزكاة في نصرة القضية الفلسطينية - مقاربة فقهية قانونية -

Abstract

تناولت هذه الدراسة موضوع توجيه أموال الزكاة لنصرة القضية الفلسطينية في ظل التشريع الجزائري، من خلال بيان الأساس الفقهي والقانوني المنظم لذلك، وتحليل النصوص الدستورية والتنظيمية المتعلقة بصندوق الزكاة والتضامن مع فلسطين. كما ركزت الدراسة على الجانب التطبيقي عبر دراسة ميدانية شملت بنك التنمية المحلية، وبنك الفلاحة والتنمية الريفية، وجمعية البركة الخيرية، للكشف عن آليات تحويل أموال الزكاة والعوائق القانونية والإدارية والإعلامية التي تواجهها. وخلصت الدراسة إلى وجود سند شرعي وتنظيمي يسمح بدعم فلسطين عبر الزكاة، مع استمرار بعض النقائص التشريعية والإجرائية، واقترحت مجموعة من الحلول لتعزيز الشفافية وتبسيط الإجراءات وتفعيل الدور التضامني للزكاة تجاه القضية الفلسطينية. This thesis examines the methods of supporting the Palestinian struggle (jihad ) through Zakat funds within Islamic jurisprudence (Fiqh). This is achieved by studying sharia evidence from the Holy Qur’an and the Prophetic Sunnah, specifically focusing on the category of Fi Sabilillah (in the cause of Allah), which a number of contemporary jurists consider to be comprehensive in supporting the Palestinian people under occupation and siege. Furthermore, the study addresses the fatwas of certain religious bodies and institutions that have permitted the directing of Zakat to Palestine. It also explores the legal and regulatory framework of the Zakat Fund in Algeria, along with transfer mechanisms via banks and charitable societies. The field study revealed several legal, administrative, banking, and media obstacles—most notably the absence of an explicit legal rule and the complexity of transfer procedures. The study concludes by proposing a set of solutions, the most important of which are: The enactment of a specific law for Zakat, The digitalization of transfer operations, and the strengthening of media and jurisprudential awareness to ensure that Zakat funds reach their eligible recipients among the Palestinian people.
