التصرفات القانونية الإدارية في ظل الإدارة الالكترونية

Abstract

إن التصرفات القانونية الإلكترونية للإدارة، والمتمثلة في القرارات والعقود الإدارية الإلكترونية، جاءت نتيجة مباشرة للتطور الكبير في الوسائل الرقمية والثورة التكنولوجية التي تعتمد عليها مؤسسات الدولة في أداء مهامها، بهدف تحسين جودة الخدمات وتوفير الوقت والجهد. ومن ثمّ، أصبح من الضروري إضفاء إطار قانوني خاص وواضح لهذه التصرفات، يحدد آليات إصدارها والحصول عليها، ويضمن لها الحماية القانونية اللازمة. وفي هذا السياق، تناولت هذه الدراسة الضوابط القانونية للتصرفات الإدارية الإلكترونية، من خلال تعريفها وبيان خصائصها، إضافة إلى تحليل أركانها الشكلية والموضوعية. وقد جاء ذلك لضمان أن تصدر هذه التصرفات وفق أسس منسجمة مع المبادئ التي تحكم القرارات والعقود الإدارية في شكلهما التقليدي، كما رسخها الفقه والقضاء الإداري عبر العصور، بما يحافظ على صحتها وسلامتها من الناحية القانونية. Electronic legal acts of the administration, represented by electronic administrative decisions and contracts, are a direct outcome of the rapid development of digital tools and the technological revolution upon which state institutions rely in carrying out their functions. This transformation aims to enhance service quality while saving time and effort. Consequently, it has become essential to establish a specific and well‑defined legal framework for such acts, one that outlines the mechanisms for their issuance and acquisition, while ensuring the necessary legal protection. In this context, the present study examines the legal regulations governing electronic administrative acts by defining and clarifying their nature, identifying their characteristics, and analyzing their formal and substantive elements. The objective is to ensure that these acts are issued in accordance with principles consistent with those that govern traditional administrative decisions and contracts, as established by administrative jurisprudence and doctrine over the ages, thereby safeguarding their validity and legal soundness.
