العقوبات البديلة وتطبيقاتها في التشريع العقابي

Abstract

تهدف هذه الد ارسة إلى تقديم تحليل مقارن وشامل للعقوبات البديلةهوتطبيقاتها في التشريعه العقابي، مع التركيز بشكل خاص على القانون الجزائري والقانون المصري. تنبع أهمية هذه الدراسة منه التوجهاته الحديثة للسياساته الجنائية التيه تسعى إلى إيجاد بدائل للعقوبات السالبة للحرية،خاصةفي الجرائم البسيطة والمتوسطة، بهدف تحقيق إصالح وتأهيل أفضله للمحكوم عليهم ، وتخفيف العبء على المؤسسات العقابية. This study aims to provide a comprehensive and comparative analysis of alternative sanctions and their applications within criminal legislation, with a particular focus on Algerian and Egyptian law. The significance of this research lies in the contemporary orientation of criminal justice policies that seek to develop alternatives to custodial sentences, especially for minor and intermediate offenses. These alternatives are intended to enhance the prospects of rehabilitation and reintegration of offenders, while also alleviating the burden on correctional institutions
