دور السياسة البيئية في توجيه الاستثمار في الجزائر

Abstract

بعد أن أدركت السياسات البيئية حجم الخطر الذي يهدّد البيئة والتراجع المستمر في مواردها الطبيعية، أصبح من غير الممكن الحديث عن تحقيق تنمية من دون مراعاة أنماط الاستهلاك غير الرشيد للموارد، والتي تقوّض أسس التنمية ذاتها. وعليه، يتعيّن أن تقوم جهود التنمية على إدماج البعد البيئي في مختلف خططها وبرامجها الاستثمارية، وأن يُنظر إلى البيئة والتنمية باعتبارهما عنصرين متلازمين، إذ لا يمكن للتنمية أن تبلغ أهدافها دون اعتماد سياسات بيئية فعّالة. وتهدف هذه الدراسة إلى إبراز الطابع الجدلي للعلاقة بين البيئة والتنمية، والسعي إلى بلورة مفهوم التنمية المستدامة بوصفه إطاراً فكرياً وسياسياً يحقق التوازن بينهما، مع البحث في إمكانية التوفيق بين متطلباتهما عوضاً عن تصور وجود تعارض بينهما. ولا يتحقق ذلك إلا عبر توضيح المفاهيم الأساسية المرتبطة بالبيئة ومشكلاتها، وعلى رأسها مشكلة التلوث، إضافة إلى تناول أهم الآليات القانونية القادرة على تحقيق التوازن بين حاجات التنمية ومتطلبات حماية البيئة في مختلف مراحل العملية الاستثمارية. كما أن اختيار الأدوات القانونية والفنية المناسبة لحماية البيئة يستوجب أولاً تحديد مستويات التلوث التي تتعرض لها، بما يسمح باعتماد الوسائل الملائمة لكل درجة من درجاته. ويأتي ذلك في إطار دعم الجهود الرامية إلى توجيه الاستثمار تدريجياً نحو مسارات بديلة تتوافق مع متطلبات التنمية المستدامة، وتواكب في الوقت نفسه التطورات العالمية في هذا المجال. After environmental policies became aware of the threats facing the environment and the clear decline in its natural resources, it was no longer possible to envision sustainable development on the one hand while allowing unrestrained consumption of natural resources on the other, as such practices undermine the very foundations of development. Accordingly, development efforts must integrate environmental considerations into their plans and investment projects, and the environment and development should be viewed as interdependent elements, since development cannot achieve its objectives without adopting sound environmental policies. This study seeks to highlight the dialectical relationship between the environment and development and to formulate the concept of sustainable development as a philosophical and policy framework that ensures balance between the two, while examining the possibility of harmonizing their requirements rather than assuming a conflict between them. Achieving this objective requires clarifying the fundamental concepts related to the environment and its major challenges—particularly pollution—as well as addressing the key legal mechanisms capable of ensuring a balance between the needs of development and the imperatives of environmental protection at all stages of the investment process. Selecting the appropriate legal and technical tools for environmental protection also necessitates first identifying the levels of pollution affecting the environment, thereby enabling the adoption of measures suitable for each degree of pollution. This approach supports efforts aimed at gradually directing investment toward alternative pathways that align with the requirements of sustainable development and keep pace with global advancements in this field.
