Abstract

تعد جريمة التعديب من الجرائم البشعة التي تطال الانسان لعدة اغراض عرقيةو دنية و طائفيةولقد لعب كل من الشريعة الاسلامية والقانون دورا هاما في التعريف بجريمة التعذيب وتبيان أركانها ً كل من الشريعة الإسلامية والقانون الدولي دور وقد لعب وتعداد الأسباب التي أدت إلى ظهورها، كما وضعا آليات ردعية لمحاربة هذه الجريمة والحد منها على الصعيدين الدولي والداخلي The crime of torture is one of the heinous international crimes that affect people for several purposes; such as ethnic, religious and sectarian purposes… Islamic law (Sharia law) and international law have played an important role in defining the crime of torture and clarifying its elements and the reasons that led to it. They have also developed deterrent mechanisms to end this crime at the international and internal levels
