-الآليات الحديثة لاستثمار الأوقاف في الجزائر-دراسة مقارنة

Abstract

تهدف هذه الدراسة إلى الآليات الحديثة التي تعتمدها الجزائر لتفعيل الاستثمارات الوقفية، مقارنة ببعض تشريعات الدول الناجحة في هذا المجال، وركزت على أهمية التحول من النمط التقليدي لإدارة الوقف إلى تبني آليات حديثة،رغم امتلاكها رصيداً كبيرا من الأملاك الوقفية،إلا أنها لا تزال تعاني من ضعف استغلال هذا المورد الحيوي، وحصره في صيغة الإيجار، نتيجة لغياب الاطار التشريعي والتنظيمي المرن، وضعف الحوكمة ونقص الكفاءات المتخصصة، في المقابل أظهرت بعض النظم المقارنة، تطوراً ملحوظاً من خلال لتوظيفها لآليات تتماشى مع واقعها العملي، وخلصت الدراسة إلى ضرورة إصلاح المنظومة الوقفية من خلال تفعيل قانون الأوقاف25/ 06،الذي يسعى إلى استدامة مال الوقفي والمحافظة عليه و حوكمة الإدارة الوقفية بإدماج سبل معاصرة تتلاءم مع طبيعة الوقف في الجزائر.

This study aims to examine the modern mechanisms adopted by Algeria to activate endowment investments, in comparison with some legislations of successful countries in this field. It focuses on the importance of moving from the traditional pattern of endowment management to adopting modern mechanisms. Despite having a large stock of endowment properties, However, it still suffers from the weak exploitation of this vital resource, and its confinement to the form of rent,As a result of the absence of a flexible legislative and regulatory framework, weak governance and a lack of specialized competencies, in contrast some comparative systems have shown remarkable development through their use of mechanisms that are in line with their practical reality. The study concluded that it is necessary to reform the endowment system by activating the Endowments Law25/06, which seeks to sustain and preserve endowment funds and to govern endowment management by incorporating modern methods that are compatible with the nature of endowments in Algeria.
