عقد الامتياز كآلية لدعم الاستثمار الفلاحي في الجزائر

Abstract

يعتبر عقد الامتياز -كآلية لدعم الاستثمار الفلاحي في الجزائر- من العقود الاستثمارية الواعدة في التنمية الفلاحية، لذا تهدف هذه الدراسة إلى تسليط الضوء على "عقد الامتياز كآلية لدعم الاستثمار الفلاحي في الجزائر" وذلك من خلال، تحليل الإطار القانوني والتنظيمي لعقد الامتياز الفلاحي ودوره في تعزيز الاستثمار الفلاحي وتحقيق التنمية المستدامة، وقد بينا فيها الإشكالات القانونية والإدارية التي تواجه تطبيق هذا النظام مثل تعقيد الإجراءات ونقص الوعي القانوني وضعف المتابعة، وتقديم مقترحات لتحسين فعاليته، كما تطرقنا إلى التمييز بين عقد الامتياز والعقود المشابهة مثل المزارعة والمغارسة والحكر، وتسليط الضوء على الأساس القانوني لهذا العقد من خلال القوانين الأساسية والتعليمات الوزارية، توصلنا في هذه الدراسة إلى أن عقد الامتياز يمثل أداة قانونية فعالة لتنظيم استغلال الأراضي الفلاحية التابعة للدولة، لكن تطبيقه يواجه تحديات تحتاج إلى معالجة لتعزيز دوره في تحقيق الأمن الغذائي والتنمية الاقتصادية. The concession contract, as a mechanism to support agricultural investment in Algeria, is considered one of the promising investment instruments for agricultural development. This study aims to shed light on "the concession contract as a mechanism for supporting agricultural investment in Algeria" by analyzing the legal and regulatory framework governing agricultural concessions and their role in promoting agricultural investment and achieving sustainable development. The study highlights the legal and administrative challenges facing the implementation of this system, such as procedural complexity, lack of legal awareness, and weak oversight. It also offers recommendations to improve its effectiveness. Additionally, the study distinguishes between the concession contract and similar agreements such as sharecropping, partnership cultivation, and emphyteusis, while emphasizing the legal basis of this contract through relevant foundational laws and ministerial instructions. The findings of this study indicate that the concession contract serves as an effective legal tool for the management and exploitation of state-owned agricultural land. However, its implementation faces several challenges that must be addressed in order to strengthen its role in achieving food security and economic development.
